Ron Simon & Associates Files First E. Coli Lawsuit Against Whispering Willows Farm and Dairy, LLC After Minor Hospitalized for Over 2 Weeks with Hemolytic Uremic Syndrome

The national food poisoning law firm of Ron Simon & Associates, along with The Matthews Firm PLLC, filed the first Whispering Willows Raw Milk E. Coli Lawsuit in Maury County, Tennessee. The firm file the lawsuit on behalf of the parents of R.H. a young girl who consumed the raw milk at her home after her parents purchased the raw milk.

A copy of the lawsuit is available upon request.

The lawsuit alleges both statutory violations, including the failure to place a conspicuous warning on all herd-share sales of raw milk, a product which is otherwise illegal to sell in Tennessee.  It also alleges negligence and strict liability against the producer, pointing to the Final Report issued by the Tennessee Department of Health, in cooperation with Tennessee’s Foodborne and Enteric Diseases Program.

The lawsuit comes as Tennessee Department of Health officials have definitively identified 13 victims, though the y believe the actual number is much higher..

Ron Simon, a world-renowned food safety lawyer who has represented thousands of E. coli and Salmonella victims in the last 20 years, today issued the following statement: “The very fact that a farm fails to use a proven kill-step, like pasteurization, when working with livestock, is worrisome enough.  In this case, much of the farm, including sensitive areas, were replete with E. coli O157:H7, the most notable pathogen in these types of outbreaks, and one the owners have admitted to not testing for.”

Food Safety Attorneys Establish E. Coli Claim Center

Mr. Simon and his law firm have established an E. coli Clain Center to assist victims in the outbreak.  The E. coli Claim Center can be reached toll-free at 1-888-335-4901 or by going to the firm’s Website, at https://www.ronsimonassociates.com/.
