Yesterday the Gomez Trial Attorneys filed an E. coli lawsuit in San Diego County against the owner and operator of Miguel’s Cocina. Miguel’s Cocina is currently shuttered in the wake of a very serious outbreak of Shiga-toxin-producing e. coli, otherwise know as STEC. The outbreak has impacted more than a dozen families who ate there between October 6th and October 18th, a 12 day period of exposure that, according to the national e. coli lawyer Ron Simon, “is an exceptionally long time for a single restaurant to be serving adulterated food. Usually food that is contaminated is linked to a single food preparation, or specific serving period, but this contamination persisted.”
The victims became symptomatic between October 13th and 19th, according to local reporting, and there may yet be victims who have to come forward. A “confirmed” victim is someone with this particular strain of STEC who ate at Miguel’s Cocina during the outbreak period. A “probable” victim will be those who may not have been tested but who ate at Miguel’s Cocina during the outbreak period and developed medically-established bloody stools and gastroenteritis. The best thing to do, says Simon, “is to be tested. A simple stool test will determine if you are infected with the particular strain of STEC.”
