First Jimmy John’s E. coli Lawsuit Filed in Major Iowa Outbreak
Ron Simon & Associates files the first Jimmy John’s E. coli O301 Lawsuit on March 5, 2020. The Lawsuit is in regards to the recent E. coli O103 outbreak which took place in Iowa in November 2019. The Iowa Department of Public Health reported that the outbreak affected a total of 22 people, one of which is being represented by Ron Simon and Associates. Health officials interviewed the affected people, who confirmed all confirmed eating at one or more of 15 Jimmy John’s locations before becoming ill.
In their investigation, The Iowa Department of Inspections discovered that the source of the outbreak was the sprouts that were being served on Jimmy John’s sandwiches. While testing both the samples of the sprouts served at the restaurants and the water used to irrigate the sprouts at the farm on which they were grown Health Department Officials discovered that both tested positive for E. coli O103. After the Health Department determined that sprouts were the cause of the outbreak Jimmy John’s decided to pull their sprouts from all of their locations in the United States.
The Food and Drug Administration (FDA) sent Jimmy Johns a Warning Letter which described five food poisoning outbreaks which have happened in the past seven years and have been linked to “adulterated fresh produce” used by the sandwich restaurant chain. One of the outbreaks stated in the warning letter was the E. coli O103 outbreak linked to sprouts served at Jimmy John’s restaurants. In the letter, the FDA spoke about the restaurant chain’s failure to correct their multiple violations, such as providing long term solutions for their contaminated produce problems and responsibility to ensure your firm complies with all requirements of federal law and implementing regulations.
In their press release Ron Simon and Associates Lead attorney Ron Simon, who represents Kahler Folkedahl and other victims of this and numerous other Jimmy John’s food poisoning outbreaks, stated: “Unfortunately, Jimmy John’s has been linked to too many outbreaks in recent years. In fact, Jimmy John’s recently received a Warning Letter from the U.S. Food and Drug Administration detailing numerous violations in the serving of contaminated sprouts spanning across the last decade. Through this lawsuit and others, we will determine how this contamination occurred and how it can be prevented in the future, so that this never happens to Jimmy John’s customers again.”
