La primera demanda de Jimmy John’s E. coli O103 es presentada.

Ron Simon & Associates presenta la primera demanda de Jimmy John E. coli O301 el 5 de marzo de 2020. La demanda se refiere al reciente brote de E. coli O103 que tuvo lugar en Iowa en noviembre de 2019. El Departamento de Salud Pública de Iowa informó que el brote afectó a un total de 22 personas, una de las cuales está siendo representada por Ron Simon and Associates. Los funcionarios de salud entrevistaron a las personas afectadas, quienes confirmaron que todos confirmaron comer en una o más de las 15 ubicaciones de Jimmy John antes de enfermarse.

En su investigación, el Departamento de Inspecciones de Iowa descubrió que la fuente del brote eran los brotes que se servían en los sándwiches de Jimmy John. La Administración de Alimentos y Medicamentos (FDA) envió a Jimmy Johns una carta de advertencia que describía cinco brotes de intoxicación alimentaria que han ocurrido en los últimos siete años y que han sido vinculados a “productos frescos adulterados” utilizados por la cadena de restaurantes sándwich. Uno de los brotes indicados en la carta de advertencia fue el brote de E. coli O103 relacionado con los brotes servidos en los restaurantes de Jimmy John. En la carta, la FDA habló sobre el fracaso de la cadena de restaurantes para corregir sus múltiples violaciones, tales como proporcionar soluciones a largo plazo para sus problemas de productos contaminados y la responsabilidad de garantizar que su empresa cumpla con todos los requisitos de reglamentos de aplicación.
